DISTANCE AGREEMENT
The seller of the goods offered in this online store, SIA "Forge Core", reg. No. 40203671821, legal address: Klapēni, Roja, Rojas pag., Talsu nov., LV-3264, Latvia, email: [email protected] (hereinafter – the Seller), of the one part, and the person placing the order (hereinafter – the Buyer), of the other part, enter into the following distance agreement.
1. Subject of the Agreement
The Seller undertakes to sell and deliver goods to the Buyer in accordance with the order placed by the Buyer in the online store, and the Buyer undertakes to pay for the ordered goods. The description, prices, and availability of the goods are specified in the online store.
2. Price and Payment Procedure
2.1. All prices are indicated in euros (€) and include VAT, if applicable.
2.2. Delivery costs are specified before the confirmation of the order.
2.3. Payment can be made using the online payment tools available in the online store (internet banking, payment cards) or by bank transfer. Payments are processed by a secure, authorized payment institution.
2.4. The invoice is prepared electronically and is valid without a signature.
3. Ordering and Entry into Force of the Agreement
3.1. The Agreement enters into force at the moment when the Buyer has confirmed the order, agreeing to it, and the Seller has confirmed the order. 3.2. The Seller reserves the right to refuse an order in case of unavailability of goods or technical errors.
4. Delivery
4.1. Delivery is provided within 3-5 business days after receiving the payment.
4.2. If delivery is delayed, the Seller shall inform the Buyer and agree on a new deadline.
4.3. The risk of damage to the goods passes to the Buyer at the moment of receiving the goods.
5. Right of Withdrawal
5.1. The Buyer has the right to exercise the right of withdrawal within 14 days from the receipt of the goods.
5.2. The Buyer sends a withdrawal notice via email or by using the form on the website.
5.3. The goods must be returned within 14 days.
5.4. The return costs shall be borne by the Buyer.
5.5. The refund is made within 14 days, strictly using the same payment method (e.g., the same payment card or bank account) from which the original payment was received.
6. Limitations of the Right of Withdrawal
The right of withdrawal does not apply to custom-made goods, goods that perish rapidly, or goods that have been excessively used. Furthermore, the return of goods may be refused, or the refund amount may be reduced, if the original packaging of the goods is damaged or protective materials have been torn off.
7. Non-conformity of Goods and Warranty
The Seller is liable for any non-conformity of the goods within 2 years from the date of delivery. The Buyer may request repair, replacement, price reduction, or cancellation of the agreement.
8. Complaint Handling and Dispute Resolution
Complaints should be submitted to [email protected]. In case of disputes, the Buyer may contact the PTAC (Consumer Rights Protection Centre) or use the EU ODR platform.
9. Processing of Personal Data
Personal data is processed in accordance with the GDPR and regulatory enactments. In order to process online purchases, personal data required for payment execution is transferred to the authorized payment institution. Detailed information is available in the "Privacy Policy" section.
10. Final Provisions
The Seller reserves the right to make changes to the agreement. The current version of the agreement is always available in the online store. The agreement is effective from the moment of order confirmation.
